رصد 575 حالة خرق ومخالفة انتخابية

 بغداد – 13 أيار 2018

تقدم شبكة شمس لمراقبة الانتخابات في العراق  تقريرها الموحد الاولي عن سير عملية الاقتراع العام ضمن سلسلة تقاريرها لمتابعة العملية الانتخابية. وهذا التقرير هو التقرير الخاص بعملية الافتتاح و الاقتراع و العد و الفرز نتائج المراكز و المحطات الانتخابية في انتخابات مجلس النواب العراقي.

 

وكانت شبكة شمس لمراقبة الانتخابات في العراق قد أصدرت بياناً أكدت فيه أنها سوف تراقب سير العملية الانتخابية في كل مراحلها، بدءأ من مرحلة ما قبل الانتخابات مع بدء حملة الدعاية الانتخابية، ومن ثم مراقبة التصويت في الخارج بالتعاون مع شبكة الانتخابات في العالم العربي والتصويت الخاص والعام واعلان النتائج.

 

بدأ مراقبو الشبكة في عموم محافظات العراق مراقبة عملية افتتاح المراكز في يوم 12 ايار 2018 بتوزيع 3310 مراقباً على المراكز و محطات الاقتراع و مخيمات النازحين.

 

ويشمل الرصد وفق لاحصائيات المفوضية عدد الناخبين الذين يحق لهم المشاركة في التصويت العام اذ يبلغ 24349357 وعدد مراكز الاقتراع 8959 تضم 55232 محطة اقتراع .

جاءت مشاركة مراقبي شبكة شمس على أساس الخبرات المتراكمة لدى الشبكة من خلال الممارسات الانتخابية السابقة من جهة، والخبرات المكتسبة من خلال الدورات الخاصة و العامة التي شارك فيها مراقبو الشبكة بالتعاون مع جميع الأطراف المعنية من جهة أخرى.

وهذا التقرير الأولي هو جزء من التقرير النهائي الذي سيصدر في وقت لاحق متضمنا كل التفاصيل والوثائق المتعلقة بعملية الرصد ، بشكل اولي تم رصد 575 حألة، منها 264 حالة خرق للاجراءات، و 311 مخالفة انتخابية.

 

 

 

التقرير الأولي

 

من أبرز ما رصده مراقبو شمس من الملاحظات الإيجابية و غير الإيجابية :

 

الملاحظات الايجابية :

1- سير العملية الانتخابية في بيئة آمنة.

2- توزيع المستلزمات اللوجستية على كافة المراكز الانتخابية وفق الجدول المحدد.

3- حضور ملاكات المفوضية ومساعديهم في الوقت المحد في اغلب المراكز الانتخابية.

4- حضور وكلاء الكيانات السياسية ومراقبي منظمات المجتمع المدني في مراكز الاقتراع.

5- استخدام تقنية متطورة وسرعة استجابة المفوضية في معالجة العطلات وبقية الإشكالات.

 

الملاحظات غير الايجابية :

1- تفاوت تطبيق موظفي المفوضية للأجراءات المطلوب تنفيذها ، بسبب عدم كفاءة بعض ملاك مفوضية الانتخابات في إدارة المراكز والمحطات الانتخابية، و عدم فعالية التدريب إضافة إلى عدم تحلي بعضهم بالحيادية.

2- تكرار عطل الاجهزة ، جزء كبير بسبب عدم خبرة العاملين من كادر المفوضية. و رصدنا حالات عطل طبيعية وكانت تتم معالجتها في بعض المراكز.  ونشك ان تكون بعض الأعطال بفعل تخريبي.

3- عدم الالتزام بسرية الاقتراع ، إذ تم خرق سرية الاقتراع عن طريق التصويت العلني و التصويت الجمعي و ايضا ادخال جهاز الخلوي الى داخل المحطات و استخدامه في تصوير ورقة الاقتراع .

4- التأثير على إرادة الناخب في التصويت ، وجود جمهرة كبيرة من وكلاء الكيانات السياسية عرقلت حركة الناخبين وأخرت انسيابية عملية التصويت، إضافة إلى رصد ضغوط مارستها الكيانات السياسية المتنفذة في بعض المناطق للتأثير على سير العملية الانتخابية.

5- خلل كبير في تنفيذ التصويت المشروط في المخيمات ، لم يجرَّ التصويت في المخيمات وفقاً للاجراءات و كانت تشوبه الفوضى، و تمت عملية ملء الصناديق و التصويت بالنيابة عن الغير و التصويت المتكرر .

6- استمرار الدعاية الانتخابية من قبل بعض الكيانات السياسية على الرغم من الصمت الإعلامي المقرر من قبل المفوضية العليا المستقلة للانتخابات.

7- استغلال مؤسسات الدولة وإمكانياتها، بضمنها الآليات، من قبل بعض المسؤولين في يوم الاقتراع لنقل الناخبين رغم وجود منع تجوال .

8- حرمان بعض الناخبين على الرغم من أن أسماءهم كانت مسجلة في الانتخابات السابقة صوتوا فيها، او من قدم أوراقه لإصدار بطاقة البايومترية ولم يستلمها، وهو فاقد للبطاقة القديمة ، والبعض الاخر بسبب تعطل مستمر في الاجهزة.

9- عدم التوزيع العادل للمراكز الانتخابية ادى الى عدم مراعاة جمهرة غفيرة من الناخبين في المناطق النائية، و بشكل خاص في محافظة نينوى، حيث شملت بعض المراكز اكثر من 10 محطات اقتراع. ما جعل بعض المراكز الانتخابية بعيدة عن مراكز إقامة الناخبين الناخبين، و اكتضاض بعض المراكز ما أدى إلى عدم انتظار الناخبين و المغادرة بدون التصويت .

 

ما يتعلق بالجهات الأمنية:

1- على الرغم من الانضباط العالي والالتزام بالحيادية الذي أتسم به سلوك القوات المسلحة والأمن الداخلي في حماية العملية الانتخابية عموماً، لكننا رصدنا حالات عديدة في بعض المحافظات يحث فيها بعضهم الناخبين على التصويت لقائمة معينة.

2- وقوع العديد من حوادث إطلاق النار غير المبرر في الانبار و ديالى و صلاح الدين و كركوك ، ما أدى الى عزوف بعض المواطنين عن ممارسة حقهم الانتخابي.

3- منع العديد من المراقبين من دخول المراكز الانتخابية من قبل الجهات الأمنية بحجج غير مقنعة، منها عدم وجود أسمائهم لديهم.

4- طرد عدد من مراقبي شبكتنا قبل بدء عملية العد والفرز وبدون أي سبب مبرر، وهذا جزء من عملية التلاعب بالعد والفرز، بالاخص في مخيمات النازحيين .

5- وجود عدد كبير من القوى الأمنية حتى داخل قاعة التصويت أحياناً وبشكل عرقل حركة الناخبين وأربك بعضهم بشأن ضمان خصوصيته في التصويت.

 

 

التوصيات

تدعو شبكة شمس إلى :

1- ضرورة الحرص على الإعلان السريع عن نتائج الأقتراع  في أقصر فترة زمنية بعد غلق صناديق التصويت، من أجل تجنب ما قد يشجع على إثارة الشكوك بشأن سلامة الفرز وعد الأصوات.

2- ضرورة إعلان نتائج التصويت التفصيلية في كل محطة وعدم الأكتفاء بإعلان النتائج النهائية العامة.

3- ضرورة توضيح ما جرى في المحطات المستحدثة في اللحظات الأخيرة وعدد  المصوتين فيها.

4- التعامل بمزيد من الشفافية مع الشكاوى والطعون بالاخص ما يتم تداوله من حديث عن التلاعب باجهزة العد و الفرز السريع في بعض المحافظات .

5- التحقق من سلامة التصويت المشروط في المخيمات، و رفض بعض نتائج التي رافقتها عملية تلاعب و تزوير كبير.

6- ضمان كفاءة أعلى لجميع ملاك مفوضية الانتخابات، سواء من حيث مستوى الإدارة، أو الحيادية، أو الجرأة في الإنهاء الفوري لأي تجاوز من أي طرف بشكل عام، و من الكيانات النافذة أو حماية العملية الانتخابية فور وقوعها، وكذلك مستوى التدريب.

7- التيقن من نوعية مستلزمات العملية الانتخابية و تطابقها مع المواصفات التي اختارتها، لتجنب تكرار ظهور نوعيات غير متطابقة كما وثقتها ” شمس ” في عطل بعض الاجهزة لعدة مرات .

8- احتساب سعة قاعات ومقتربات المراكز الانتخابية ومحطاتها وتحديد أعداد المراقبين والحماية بشكل يحول دون عرقلة و إرباك العملية الانتخابية.

9- منع أي شكل من التصرفات الكيفية للجهات الأمنية في التعامل مع مراقبي الانتخابات و منعهم عن المراقبة، وفي بعض الأحيان حجزهم بدون أي مبرر.

10- التحقيق مع موظفي المفوضية ممن تهاون في تطبيق الاجراءات، وفرض عقوبات اشد بالاخص ما تتعلق بتخريب الاجهزة و الترويج لمرشحين و كيانات، و السماح بادخال الأجهزة النقالة الى مركز محطة الاقتراع .
